Understanding the HVCC

On May one, 2009, the lawyer General’s Office of New York enacted the HVCC, or Home Valuation behavior code. In conjunction with Fannie Mae and Freddie Mac, the Attorney General developed the HVCC to restrict the potential inflationary practices of home appraisals.

One way the HVCC limits the infationary practices of appraisals is by requiring the lender to supply the borrower with free copies of the appraisal inside three business days.

Now, 10% of appraisals are to be at random selected, tested, and reported by banks to Fannie Mae or Freddie Mac. In-home appraisers are going to be independent of the sales staff of the lenders, and their compensation should not reflect their guesses of value or precise loan closings. Misconduct of appraisers, , should be reported to state agencies.

The HVCC affects 1-4 Family loans purchased by Fannie Mae and Freddie Mac. It doesn’t affect FHA, VA, or jumbo loans. Private assignments are also untouched, such as divorce appraisals, bankruptcy appraisals, tax grievances and tax appraisals. The HVCC applies only to appraisals, so automated valuation models, broker prices options, and tax assessments remain unaffected.

In contrast to common belief, communication between the estate agent and the appraiser isn’t specifically restricted by the HVCC ; however, it is intended to legally stop the appraiser from getting payment for the appraisal right from the borrower. A bank must authorize a 3rd party to select, keep, and provide for all compensation to the valuer.

The HVCC does not require the use of AMCs, Appraisal Management firms. Appraisals might be ordered by banks from indivdual appraisers. As long as mortgage brokers are selecting, keeping, or providing payment of compensation to the appraisers, they are allowed to use specific AMCs directed by lenders that use a group of authorized AMCs.

Lenders are restricted from accepting appraisals that were ordered by mortgage brokersw. Mortgage brokers are restricted from directing banks with a list of selected appraisers to use.

The HVCC puts restrictions on not only the end user, but also every individual and company working in the Home Valuation industry. Fannie Mae and Freddie Mac are the only associations to implement such regulations ; however, many regime organizations have outstanding policies that may also affect responsibility to both speculators and lenders.
